This is the GoConnect User Policy for the GoConnect Internet Service Provider (ISP) Plans.

Please read the GoConnect User Policy carefully, as compliance with it is a term and condition of use of the Service and forms part of the GoConnect Terms and Conditions of Use, as amended from time to time. The terms defined in the GoConnect User Policy have the same meaning as in the GoConnect Terms and Conditions of Use.

1.1 Any Minor must have included the following information in their Application:

1. the name of a parent or guardian ("Authorising Adult");

2. the telephone number, street address and e-mail address or other relevant contact details of the Authorising Adult; and

3. The Payment Authority which is required to be in the name of the Authorising Adult and the Authorising Adult consents to the Payment Authority.

1.2 GoConnect may seek consent from the Authorising Adult before providing the Minor with access to the Service.

1.3 GoConnect may report to the Authorising Adult of the provision and use of the Service by the Minor and any time and seek confirmation from the Authorising Adult of his or her consent to the provision and continued use of the Service by the Minor.

1.4 GoConnect may, at its sole discretion refuse to register the Minor as a Member where the Minor fails to provide relevant contact details of an Authorising Adult in accordance with clause 1.1, or if such Authorising Adult fails to provide consent for the provision, use or continuing use of the Service by the Minor.

1.5 The Member acknowledges that some content accessible through the use of the Service is unsuitable for Minors. The Member warrants that no Minor will use the Service without the express permission and personal supervision of the Member using either the Member's or any other person's Log-In Particulars. GoConnect does not accept any responsibility for the use of the Service by a Member who is a Minor where the Minor has advised that an Authorising Adult has consented to the Minor using the Service, or where GoConnect has sought the consent of the Authorising Adult to provide or continue to provide the Service to the Minor.

Where content is served only to members over 18 years of age, GoConnect uses the date of birth information supplied by the member during registration as the basis of filtering.

GoConnect reserves the right to delete any e-mail message sent to the Member at any time, without notifying the Member of such action, if:

• the size of the e-mail received (including attachments) exceeds 1 megabytes ("MB");

• all of the Member's undeleted e-mail messages (including attachments) exceed 10 MB;

• an e-mail message (whether read or unread) has not been deleted by the Member within 60 days of that message becoming available to the Member.

In order to minimize network congestion and enable Members to reasonably access the Service without unreasonable delay, GoConnect has a discretion to limit the amount of information downloaded and limit the amount of bandwidth used by a Member.

To preserve the integrity of GoConnect and of the Service, GoConnect may take action under clause 3.19 and clause 5 of the Option Plan Terms and Conditions of Use against Members who use the Service for unauthorised purposes. These unauthorised purposes include:

1. unauthorised use and frequent downloads deemed to be carrying out usage which is not of a personal nature and is of a nature and/or extent of a profit-making enterprise or in the nature of a commercial or business activity (examples as outlined in clause 3.19 of the Option Plan Terms and Conditions of Use);

2. information which may be viewed as commercial activity;

3. sending unsolicited commercial e-mail messages;

4. distributing messages to inappropriate or unrelated forums, newsgroups or mailing lists;

5. transmitting, publishing or receiving any harassing, threatening, obscene, abusive or indecent materials including, but not limited to, material promoting physical injury or harm against any group or individual, material containing nudity or pornographic material of any kind, or material exploiting Minors;

6. any activity that may damage, modify or destroy the files, data, devices or resources of GoConnect, other Members of GoConnect or any third parties;

7. any activity which is prohibited under the governing law of the Terms and Conditions of use;

8. any unauthorised entry or hacking into any other computer or machine accessible using the Service

5.1 Members may make a complaint to the Australian Broadcasting Authority ("the ABA") in relation to any Internet content the Member believes may be prohibited content or potential prohibited content (as defined in the Broadcasting Services Act 1992 (Cth)).

5.2 In order to make a complaint, a Member may access the ABA website and follow the procedures for making a complaint as outlined by the ABA.

While Members are able to access external servers as part of the Service, GoConnect reserves the right to restrict the Members' access to external servers where ability to access such servers is abused or during peak load times. These external servers include, but are not limited to, external chat servers, external e-mail servers, messaging servers, game servers and file transfer protocol (FTP) servers.

GoConnect may amend this User Policy from time to time by publishing such amendments on the GoConnect Website. The obligation is on the Member to check the GoConnect Website to monitor whether any such amendments have been made. The Member's continued use of the Service after publication of the amendments will constitute the Member's acceptance of such amendments.

Members acknowledge that GoTrek may interfere with certain but not all full screen applications. These applications may include certain full screen games and in this instance, GoTrek may disconnect the Member.
